Man arrested after police find child, open beer container in SUV

A 35-year-old man is facing DUI and child endangerment charges after police allege he was driving under the influence with a child in the vehicle.  

Police stopped a GMC Yukon around 11:20 p.m. Aug. 29 after finding the vehicle’s registration was expired, according to a probable cause statement. 

Police noted the SUpassed several locations “where it could have safety stopped” before pulling into a small strip mall parking lot on John Wayne Parkway and Fiest Drive. A records check showed the driver, David Zuniga, was driving on a suspended license with a child in the backseat, according to the probable cause statement. 

When Zuniga exited the vehicle, police noticed that he smelled of alcohol and was unable to walk a straight line. They also allegedly found an open container of beer spilled on the backseat next to the child. 

Zuniga told police he had two beers at dinner prior to driving. 

A preliminary breath test showed Zuniga scored a result of 0.134above the legal limit of 0.08%. 

He was arrested on suspicion of aggravated DUI, endangerment of a minor and driving on a suspended license.
